1. Platform Role as Marketplace Facilitator

PitchNow Live operates as a marketplace facilitator, providing a platform for independent sellers to list, promote, and sell their handmade products to buyers. PitchNow Live is not the manufacturer, producer, or seller of record for any products listed on the platform.

PitchNow Live's role is limited to:

• Providing the technology platform and tools for sellers to create listings and conduct live sales
• Facilitating payment processing between buyers and sellers through third-party payment processors
• Providing communication tools for buyers and sellers to interact
• Offering dispute resolution assistance as described in our Terms of Service
• Enforcing platform policies, Code of Conduct, and community standards

All transactions on PitchNow Live are between the buyer and the individual seller. PitchNow Live is not a party to any transaction and does not take title to or possession of any products sold on the platform.

2. No Warranty on Seller Products

PitchNow Live makes no representations or warranties regarding the quality, safety, legality, accuracy of description, or fitness for a particular purpose of any product listed on the platform. Specifically:

• Product Quality: PitchNow Live does not inspect, verify, or guarantee the quality of any product sold on the platform. Buyers purchase at their own risk.
• Product Descriptions: Sellers are solely responsible for the accuracy and completeness of their product descriptions, photographs, pricing, and material specifications. PitchNow Live does not verify the accuracy of listing content.
• Handmade Claims: While PitchNow Live is designed for handmade and artisan products, we cannot independently verify the production methods of every item. Reports of mass-produced items misrepresented as handmade can be submitted through our reporting system.
• Safety and Compliance: Sellers are responsible for ensuring their products comply with all applicable safety regulations, labeling requirements, and consumer protection laws.
• Livestream Content: Product demonstrations during livestreams are created by sellers. PitchNow Live does not verify claims made during live sessions.

Buyers are encouraged to review seller profiles, ratings, reviews, and product descriptions carefully before making a purchase. Watch live product demos when available for additional product information.

3. No Warranties — Platform

PitchNow Live is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

PitchNow Live does not warrant that:

• The platform will be uninterrupted, timely, secure, or error-free
• The results obtained from use of the platform will be accurate or reliable
• Any errors in the platform will be corrected
• Livestreams will be available at all scheduled times or will function without technical difficulties

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PITCHNOW LIVE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM:

• Your use of or inability to use the platform
• Any products purchased through the platform, including but not limited to product defects, damage during shipping, or failure to meet expectations
• Any conduct or content of any seller, buyer, or other third party on the platform
• Any unauthorized access to or alteration of your transmissions or data
• Loss of revenue, profits, business, or anticipated savings
• Any technical failures, including livestream interruptions, payment processing errors, or data loss

IN NO EVENT SHALL PITCHNOW LIVE'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE PLATFORM EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO PITCHNOW LIVE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if PitchNow Live has been advised of the possibility of such damage.

5. User Ratings and Reviews

Product ratings and reviews on PitchNow Live are submitted by individual buyers. PitchNow Live does not verify the accuracy of reviews and does not endorse the opinions expressed. Reviews reflect the personal experience of the reviewer. PitchNow Live moderates reviews for compliance with our Code of Conduct but does not modify or edit review content.
